A Date For The DMV Hearing Has Been Set, FAQ

Matthew Ruff, Attorney at Law

Great news, a DMV hearing has been set for you case. The purpose of the DMV hearing is to challenge the suspension that was set in place when you were served with the pink “notice of suspension” at the time of your arrest or release from custody.

All DMV hearings are now telephonic, meaning the entire hearing will take place over a conference call with the attorney and the DMV Hearing Officer assigned to hear the case. In some cases testimony from you may be required in order to present evidence relevant to defenses that may exist. Once the attorney receives the evidence in the case including all police re, chemical test results and any other written reports the attorney can determine whether your attendance is necessary. In the meantime, simply calendar the date and time to keep your availability open.

What about my license? The attorney requested and was granted a stay of the suspension, this means your driving privileges remain valid pending an outcome of the hearing. You will be mailed a new temporary license to replace the pink paper you currently may be using.

“Pink” Temporary License and Notice of Suspension

Will I get a photo license? No, if you need a photo ID you can go online to the DMV website or visit a local office to request a California ID card or try and get a duplicate license, however sometimes this is denied pending the outcome of the hearing.

What do I need to do now? Nothing, the attorney is handling everything, just comply with any specific requests Matthew asks of you.
