On Thursday the 27th the Torrance Police Department issued traffic tickets to 63 motorists as part of a planned sting operation targeting motorists for using their cell phones while driving, according to law enforcement officials.
TPD issued the tickets from 11:30 a.m. to 1:30 on Hawthorne Boulevard between Carson Street and Lomita Boulevard. Officers cited drivers seen talking and texting on their cell phones while driving. The vehicle code prohibits the use of any cell phone while driving without a “hands free” device. The cost of the tickets in Court are more than $140 with penalties and assessments.
The interesting question from the attorneys perspective is what constitutes “driving” within the context of the citation. One can only presume that driving means movement of the vehicle, which means that if you are talking on your cell phone in your car while stopped at a red light that would not be a violation of the law, your comments are always welcome.
