Fighting for the rights of clients is what Matthew does. In this case the arrest was found to be unlawful and the DMV agreed to set aside the license suspension following a hearing.

The client was arrested on Interstate 5 in Los Angeles for driving under the influence. A breath test at the scene was conducted and results of .15/.14 were reported. Despite these facts Matthew fought the case and was able to show the arrest was not lawful. The actual decision of the DMV is shown below:

As a result of the decision, the client got his license back and the charges in DUI charges in court were later dropped. Having the DMV charges dismissed allowed the client to avoid the consequences of an ignition interlock, SR22, and other mandatory punishments.

The case law Solivij v. Gourley, (2001) 87 Cal.App.4th 1229 states, “In order to justify a stop or detention the officer must have specific and articulable facts causing him to suspect that some activity relating to a crime has taken place, is occurring or is about to occur, and that the person detained is involved in that activity.”
